Terms of Use

These terms govern your use of the VS Points iOS app, made by Sam Davis, an independent developer based in the United Kingdom. The app is listed on the App Store as VS Points and appears as Points on your home screen — both names mean the same app. By using it you accept these terms.
VS Points is not affiliated with, endorsed by, or connected to Virgin Atlantic Airways Limited. "Virgin Atlantic" and "Flying Club" are trademarks of their respective owners, used here only to describe what the app searches.
What the app does
VS Points shows reward seat availability and points prices for Virgin Atlantic flights, gathered from publicly available sources. It is a search and monitoring tool. It does not sell flights, hold reservations, or act as a travel agent, and it has no access to your Flying Club account.
Accuracy
Availability and pricing change constantly, and the information in the app may be out of date, incomplete, or wrong. It is offered for guidance only.
Round trip prices are a particular case: the app adds together two one-way reward fares, and Virgin Atlantic prices seats differently when they are booked as a round trip, so the real price may be higher or lower than the total shown.
Always confirm availability and price with Virgin Atlantic before making any booking or travel decision. We are not responsible for bookings made, missed, or mispriced on the basis of what the app showed.
Prices in the app are also not live. Routes and dates are refreshed on a rolling schedule rather than checked the moment you look, so what you see can be up to around a day old, and a change that appears and disappears between refreshes may never show up at all.
Availability
The app depends on things outside our control: Apple's App Store and push notification systems, your device and network, our hosting provider, and the publicly available Virgin Atlantic sources the flight data is gathered from. If any of those change, fail, or become unavailable, parts of the app — or all of it — may stop working.
We don't promise the app will be available without interruption, or free of errors. It is built and maintained by one person. We fix problems as quickly as we reasonably can, and we'd always rather hear about one than have you sit with it.
Because the flight data comes from a source we don't own or control, there is a real possibility that it becomes unavailable to us — temporarily or permanently — with no notice. If that happens the app cannot show reward seat information, and Points Plus features that depend on it cannot work. What we'd do in that situation is set out below.
Points Plus subscriptions
Points Plus is an optional auto-renewing subscription that unlocks flight notifications — for a price drop, a price rise, or a saver seat appearing — along with full price history and intelligent search.
Price
Points Plus is £2.49 per month, renewing monthly.
Prices shown here are for the United Kingdom. The price that applies to you, in your local currency, is always the one shown on the subscription screen in the app before you confirm.
Billing and renewal
- Payment is charged to your Apple Account when you confirm the purchase.
- Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within the 24 hours before the current period ends.
- You can manage or cancel your subscription at any time in your Apple Account settings, or from the account screen in the app.
About notifications
Notifications are sent on a best-effort basis. Each flight's price is rechecked roughly once a day, and a separate pass runs every hour to compare those prices against your alerts. So a notification normally reaches you within an hour of the recheck that spotted a change — but that can be up to a day after the change itself. A change that appears and disappears between rechecks may not trigger a notification at all, and occasionally one will be lost in delivery and not sent again. Delivery also depends on Apple's push notification service, your notification settings, and your network.
Please don't treat a notification as your only way of catching a price or a seat. If a trip matters, check the app, and check with Virgin Atlantic.
If something isn't working
If something you're paying for isn't behaving as it should — notifications not arriving, Points Plus not unlocking, price history missing — please get in touch before anything else. Emailing from the account screen in the app fills in the details that help most.
If the problem is that Points Plus isn't unlocking, try Restore Purchases first: open Get Points Plus from the account screen and tap Restore Purchases at the bottom. That re-checks your subscription with Apple and resolves most access problems on its own.
Otherwise we'll look into it, tell you what we find, and release a fix where one is needed. Where a fault has meaningfully affected time you've paid for, we may offer a free period of Points Plus to make up for it. Refunds themselves remain Apple's to give — see below.
If your subscription ends
Your notifications aren't deleted when Points Plus ends. They stay on their flights, marked as paused, and stop being sent until you subscribe again. Price history returns to the free time range, and intelligent search locks. Your saved flights are unaffected.
Refunds
All purchases are handled by Apple, so refunds are handled by Apple too, under their terms. We cannot issue refunds directly. You can request one at reportaproblem.apple.com. Nothing here affects your statutory rights as a consumer.
Changes to the subscription
Features may be added, changed, or removed over time. If prices change, existing subscribers are notified by Apple and asked to agree before any increased price is charged.
If the service has to stop
If the flight data becomes unavailable to us, or we otherwise have to withdraw Points Plus or the app, here is what we will do:
- Stop selling new subscriptions straight away.
- Tell you inside the app, and in the App Store release notes.
- Not renew any subscription beyond the term already paid for.
- Support your refund request to Apple for the part of your subscription you can no longer use, rather than contest it. Email us and we will confirm in writing what stopped working and when, so you have it to hand.
One thing we cannot do is take the money back ourselves, or cancel your subscription for you. Apple is the seller, holds the payment, and is the only party that can refund it or stop a future charge.
Affiliate links
When you tap through to book, the app may use an affiliate link, and we may earn a commission on any resulting booking — in practice on cash bookings rather than points redemptions. This costs you nothing extra and never changes the flights, prices or ordering the app shows you.
Acceptable use
Please don't attempt to break, overload, scrape, reverse engineer, or resell the app or the service behind it, or use it to do anything unlawful. We may withdraw access if you do.
Ownership
The app, its design, and its content belong to Sam Davis, except for third-party material used under licence and airline names and marks, which belong to their owners. Your subscription grants you a personal, non-transferable right to use the app — nothing more.
Liability
The app is provided "as is" and "as available". To the extent the law allows, we exclude liability for indirect or consequential loss, for loss arising from your reliance on flight information shown in the app, and for loss arising from the app being unavailable, a notification not arriving, or a feature not working as expected.
Where we are liable to you, our total liability for all claims connected with the app or a Points Plus subscription is limited to the greater of £20 or the amount you paid for Points Plus in the 12 months before the claim arose.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including for death or personal injury caused by negligence, or for fraud. And if you are a consumer, you have legal rights where paid digital content is faulty, not as described, or not of satisfactory quality. Nothing on this page affects those rights, and nothing on this page is meant to talk you out of using them.
Apple
These terms are between you and Sam Davis. Apple is not a party to them, and has no responsibility for the app, its content, or its maintenance and support. Apple's Media Services Terms and Conditions also apply to your purchase, and your licence covers use on Apple-branded devices that you own or control, as those terms allow.
A few things Apple's agreements require custom terms like these to spell out:
- If the app fails to conform to a warranty the law implies, you may notify Apple, and Apple will refund you what you paid for the app. To the maximum extent the law allows, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any claim relating to the app — including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone else's intellectual property.
- You confirm that you are not located in a country subject to a United States government embargo or designated by the United States as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms, and may enforce them against you.
Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed, and continued use of the app after a change means you accept the updated terms.
Governing law
These terms are governed by the law of England and Wales, and are subject to the non-exclusive jurisdiction of its courts. If you are a consumer elsewhere, you keep the protections of your local law.
